Lawsuits based on a false understanding of how the models work and what training a model actually entails are doomed to failure.
A lot of the people pushing back against AI training on copyrighted works are still stuck with the idea that the models are making collages out of artists' paintings or assembling new articles out of snippets of different authors' written works. That understanding is totally off base. I am concerned that politicians will try to appease their prospective voters by deliberately pretending to share their same misunderstanding of how the models work.
Full disclosure, I usually vote with the Democrats, but in California I could certainly imagine unscrupulous Democrats courting the votes of liberal Hollywood types and creatives by feeding their misunderstandings and Luddite fears. Republicans do the same kind of thing and worse on other issues. I am concerned about regulatory capture by the larger companies. Much of what's going on right now with lawsuits and politicians talking about AI regulation is performative -- a dog and pony show.    See Less
